I have the honour to acknowledge

the receipt of your Despatch No. 79 of the 28th. April

transmitting a copy of a letter from the Secretary of the

Merchant Service Guild regarding the case of Captain Bell

Smith formerly of the Steamship "Wing Chai" and the cons-

-titution of the Court of the Marine Magistrate in this

Colony.

The Guild appear still to misap-

-prehend the circumstances under which Captain Bell Smith

was prosecuted by the Master of the S.S. "Yin King" as the

parallel at Shanghai to which they refer was a case before

the High Court in Admiralty Jurisdiction, corresponding

to a case before the Marine Court in Hongkong, rather than

to one instituted on a Police Court Summons. In the Marine

Court constituted under Section 19 of the Merchant Shipping
